Make them fix it and no charge of your services in the first place. it never hurts to ask a lawyers opion. Cuz if later the car messes up and it was all linked to the smashing they will have to pay for it.
As long as you get pictures of the damage before hand . I would let them repair it unless you want to get your insurance involved . Are the a body shop ?
the shop and/or mechanic is obligated by law ( in US ) to return your car to you in the very least, as exactly how it was when you delivered it to them in the first place. cars/trucks are personal property. and under the law are considered such. and expensive property at that.
You have every right to approach the shop foreman/supervisor and demand the car be fixed at THEIR expense. and dont take the car back until YOU are satisfied with the repairs. dont forget to get a reciept of the repairs as now your car has been ‘officially’ wrecked. this will aid you later on if their repairs end up causing problems at a later date.
As always you have the right to seek legal counsel. Dealerships in general fight consumers tooth and nail about stuff like this. and more so now that the american auto makers are going down the tubes. Dont forget lawyers are crooks too. chose one that seeks his payment through the damages paid by the ones who damaged the car. its not fair for you to pay a lawyer when you didnt cause this problem. All in all you have the right to get your car back, fixed, at no cost to you, no matter what hassle you go through.
This all balances on the fact YOU can prove they damaged your car. so get your ducks in a line and have at them!
Well if you signed something that protects them then idk but I think they should replace it if it’s never gonna be the same. It’s their fault so they should replace it to the way it was when you gave it to them at least.
