If the car was being used witout your authorization…there should be an additional charge against the person driving it at the time of the accident! You can recoupe those damages thru restitution no law suit necessary. If you want to sue for breach of contract…you need to file suit. If you want to get a judgement in excess of 5k (in NY) you can not file small claims. My suggestion take what you can get in small claims so you dont have to pay the lawyers!

For those of you who doubt the validity of this story, I have to admit, I get clients with outrageous problems like this every day… Your most cautionary remedy would be to contact your county Bar Association to refer you an attorney specializing in consumer and civil matters. Upon reviewing your case, they may refer you to your local magistrate, where you will need to file a complaint and attend a hearing. If they do not find in your favor, then an attorney would step in if you have a viable basis for appeal.
