So, we finally got reimbursed for my car, and purchased a replacement.
38 days after buying this ‘new to us’ car, it gets smashed by a hit & run driver. Probably totaled out due to the age of the car, doesn’t look bad but the whole back end is in need of repair, everything except the drivers side lights, oh & the trunk door is OK too.

So the police are searching for him. They have (as do we) the VIN # of the vehicle, description of the driver, description of the vehicle, and license plate # of the car.
Probably the one good thing in this is a witness called in the plate # and this witness’ desciption of the driver is the same as my husband’s recollection.

So if this person has insurance (we hope he was just DUI or DWI, due to my husband’s recollection of the driver’s actions after the accident) & it’s after the usual 2 week period to make a claim does the insurance company automatically deny the claim?
What happens if they do deny the claim?

We were kind of hoping the worst case scenario is that the driver doesn’t have insurance & our company takes care of our car. (no injuries, no whiplash, nothing). We do have uninsured motorist coverage.

And how long does it really take to track down the car/driver, especially since the police have all the info? It’s been about 11 days, and my Husband was told it would be 2 weeks before they knew anything.

Ideas? help?
Experiences?
What if, when found, this person has ‘fixed’ their car & denies all part in the accident? What then?

What if the car was stolen?
We’ll be contacting our attorney to see if we should do that. (he never answers his phone tho I swear!!And he never calls back not even his mom!!!) I’ve thought about it, but like I said say we contact our company & this driver denies it happened, hey look at my car it’s fine, what if this is a battle?
Will our insurance company deny it then?

Like I said there’s a witness but it’s not like we have the witnesses name or anything. It wasn’t on the ‘traffic accident information form’
And to our knowledge there isn’t a police report.
Won’t it be a problem say if the police don’t file a report? I mean the cops don’t have to do a thing ya know? (they did nothing for my accident, protocol wasn’t even followed so I’m not into the whole ‘trusting the cops’ on this one)

You know what a friend told me.
She said the insurance company isn’t even going to believe us when we say we bought this car literally 38 days before a ‘hit & run’ accident.

I never even thought of that.
We have the check stub proving when we purchased it, not to mention my inlaws witnessed the purchase of the car and other people saw us buy it…and a witness to the accident, ( I keep repeating that because I freaked the heck out after the accident…), so they have to believe us right?

Do I have to worry about them believing us? I had to get the calendar & sure enough 38 days we owned the car.

What luck we have.
Another year of no car.

Sorry kids mommy can’t take you to the DR someone took our car from us.

Hello people, please help me out.
My car was parked in a private parking area and the front part was smashed by a driver when he was backing a van. I have already gone filed a claim with his insurance company and the company has already assigned an adjuster to me and he is gonna call me today, i havent talked to him at all, i just left voice mails to call me back asap. My car’s front part was smashed, rightside headlight was out of place / snatched out, grills were torn and some bolts or parts might have fallen down at the accident spot. Should i demand for repair or total my vehicle ? My classes are gonna start from Tuesday so i’m in a deep deep trouble now, i dont have any rides. I have these questions :

1. I have permit but the accident happened while the car was parked, so is there any problem for me? cuz all fault was of the other party.
2. If they provide me with a rental and i dont have the license, but my best friend/ roommate does, can we take the rental car on his driver license and he n i will use the car to go to college? is it compulsory for the rental to be on my name?
3. will the insurance company give at least some downpayment for totalling the vehicle because I really need to buy another car if i have to because i have to go college 4 days a week. so frends, u can figure out how much i need a car.

please help me out frends,,,, this was my first car accident and my car was parked !!,,, I appreciate you for any advice, thanx

I was in an accident last night, where I was driving on the highway (FDR) and a tire flew off of someone’s SUV and smashed the top of my car and windsheild. This also caused my passenger (my fiancee) to be knocked out cold. I reveiwed my policy and I dont have comprehensive or collision coverage, so what am I to expect? I’m figuring I’d have to pay for repairs myself, not to mention they had to cut my passenger side door off to get my fiancee out. Anyone know what I am to expect?? Thanks you all for help.
Sorry guys, failed to mention the other driver didnt stop, neither did any1 else 4 that matter. They didnt even find the tire that hit the car. It was totally wierd, as if it were a dream.

OK – so it was this lady’s fault, smashed right into him. She’s admitted was her fault and she has full insurance, my son only has 3rd party.
Both doors and pillar damaged (maybe structural as well)
It’s not an expensive car, my son is 17 – first car, couldn’t afford a flash one – anyhow, so I would think the repairs would outweigh the cost of the car.

So does Insurance only pay out the market value only, or market value plus a bit more, or trade in value…

What could I expect as I’ve never dealt with Insurance before, just heard they screw everyone over :-(

What I mean about ‘extra’ is we’ve just spent a grand on it in the past 4 months, engine work done and brand new radiator etc….

OK – so it was this lady’s fault, smashed right into him. She’s admitted was her fault and she has full insurance, my son only has 3rd party.
Both doors and pillar damaged (maybe structural as well)
It’s not an expensive car, my son is 17 – first car, couldn’t afford a flash one – anyhow, so I would think the repairs would outweigh the cost of the car.

Ok so about year ago I got into a accident (I drive a c230 mercedes benz sport). I was waiting behind a suv at a red light and some guy comes from behind at like 50 mph and hits me well I hit the guy in front but nothing happens to the guy in front because he had a reece on the back of his suv so he walked away with no scratch on his car. But my cars front and rear were smashed in literally, but the air bags didn’t deploy so It wasn’t to bad I believe this is because I was at a standstill and I took the hit directly so it wasn’t that bad. Any way my insurance company said they will repair it and that it wasn’t a total loss. They estimated about 15000$ or so, but in the end they paid about 26000$ for all the repairs. I bought the car at about 32000 to 34000 or so. Now about a year later a company sent me a letter telling me I can get money back for the diminished value on my car. They are asking for a third of anything I get back. They also said they were part of the state adjustor’s. I’m guessing I will get back like 10 grand or so, but is there a way to get back all the money without a company taking a chunk out of it?…..Oh and also the guy who hit me didn’t have insurance at the time, but I’m guessing he does now so how could that effect me?

Today someone cut me off on my street, I turned my car to avoid hitting them, but hit the curb. They kept going, and of course I stopped…I didn’t think anything happened except that my hub cap flew off…I was only going 20k if that, yet, the rim smashed and now something called the table bar on the right side.. so, the repairs costs less than my deductable,so obviously I won’t claim that, however, if there is more damage they don’t see…is any of this covered by insurance..I mean in general, does another car have to be involved in an accident to claim something, say my frame is bent and the car is totaled is this type of thing covered….Thanks for any info anyone can give me :)

My daughter slid on some black ice and into another vehicle. No damage was done. The other driver basically said no harm no foul. The police were not called and both vehicles left, only exchanging information. This was in February 2008, now my daughter receives a bill from their insurance for repairs to the car. Is she responsible for this bill? Again ,no police report filed, and she was told everything was okay.
